  • Technical information: your IP address, browser type, device information, the pages you visit and the date and time of your visit, collected through cookies and similar technologies (see section 9).

We do not ask for special personal information (for example health, religious beliefs, race or criminal records) through this website. Please do not include it in your messages.

4. How we collect it

  • Directly from you, for example when you complete our contact or valuation form, email or phone us, or meet us at a viewing.
  • Automatically, when you browse our website.
  • From third parties, such as property portals, your attorney, conveyancer, bond originator or bank, or public sources such as the Deeds Office, where this is lawful.

5. Why we use your information

We use your personal information only for the following purposes, and only where we have a lawful basis to do so:

  • To respond to your enquiries and requests, including valuations and viewings. Basis: taking steps at your request, and our legitimate interests.
  • To market, sell or let properties on your behalf, including preparing listings. Basis: our agreement with you, and your consent where required.
  • To match buyers and tenants with suitable properties. Basis: our legitimate interests, and your consent where required.
  • To comply with the law, including the Financial Intelligence Centre Act (FICA), the Property Practitioners Act and tax legislation. Basis: legal obligation.
  • To keep our website secure, prevent fraud and improve our services. Basis: our legitimate interests.
  • To send you marketing about our services and properties, but only as set out in section 6.

When we ask you for information, we will tell you whether providing it is voluntary or required by law. If you choose not to provide information we need to respond to you or to meet a legal requirement, we may not be able to assist you.

We collect only what is necessary for these purposes and will not use your information for an unrelated purpose without telling you or getting your consent.

6. Direct marketing

We send electronic marketing (email, SMS or WhatsApp) only if you have given your consent, or if you are an existing client and the message relates to similar services, and in both cases only after giving you the chance to opt out. Every marketing message will include a simple way to unsubscribe. You can opt out at any time by using that link or by contacting our Information Officer. We never sell your personal information.

7. Who we share your information with

We share only what is needed, and only with:

  • Service providers who help us run our business, such as website hosting, email, online forms, customer-relationship management, analytics and IT support providers. They must keep your information confidential and secure.
  • Transaction professionals, such as conveyancing attorneys, bond originators, banks, valuers, inspectors and, where relevant, other property practitioners, to progress a sale or rental.
  • Property portals and marketing channels, when you have instructed us to market your property. Listing details are public once published.
  • Authorities and regulators, where the law requires or permits it, including the Property Practitioners Regulatory Authority, the Financial Intelligence Centre, SARS, the Information Regulator and the courts.
  • A successor to our business, if it is sold or restructured, on the basis that this policy continues to apply.

8. Transfers outside South Africa

Some of our service providers, such as email, cloud storage or analytics providers, may store or process information outside South Africa. We transfer personal information abroad only where POPIA allows it: where the recipient is bound by law, binding corporate rules or an agreement that gives your information protection substantially similar to POPIA; where you consent; or where the transfer is necessary for a contract with you or in your interest.

9. Cookies and analytics

Cookies are small files stored on your device when you visit a website. We use:

  • Essential cookies, which keep the website secure and working.
  • Analytics cookies, which show us in aggregated form how visitors use the site so we can improve it.

You can control or delete cookies in your browser settings. Blocking essential cookies may stop parts of the website from working. Where we use non-essential cookies, we will ask for your consent through a cookie notice.

10. How long we keep your information

We keep personal information only for as long as we need it for the purpose it was collected, or for as long as the law requires or permits. For example, FICA requires certain client records to be kept for at least five years after a business relationship ends or a transaction is concluded. Enquiries that do not lead to an instruction are kept for 3 months and then deleted or de-identified.

11. Security and breaches

We take reasonable technical and organisational steps to protect your information, including secure (HTTPS) hosting, access controls, backups and confidentiality obligations for our staff and service providers. No method of transmission over the internet is completely secure, so we cannot guarantee absolute security.

If your personal information is compromised, we will notify the Information Regulator and you as soon as reasonably possible, as POPIA requires.

12. Your rights

Under POPIA you may:

  • ask whether we hold personal information about you, and request a copy;
  • ask us to correct or delete information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or unlawfully obtained;
  • object, on reasonable grounds, to our processing of your information, and object to direct marketing at any time;
  • withdraw your consent at any time (this does not affect processing that already took place lawfully); and
  • complain to the Information Regulator.

To exercise any of these rights, email our Information Officer at hello@driftestates.co.za. We may need to confirm your identity first. Where the law allows, a prescribed fee may apply to access requests.

13. Children

Our website and services are not aimed at anyone under 18, and we do not knowingly collect a child’s personal information without the consent of a parent or guardian. If you believe a child has given us information, please contact our Information Officer and we will delete it.

14. Links to other websites

Our website may link to other sites, such as property portals or social media. We are not responsible for their content or privacy practices, so please read their policies.

15. Changes to this policy

We may update this policy from time to time. The current version is always on this page with its “last updated” date. If we make a significant change, we will take reasonable steps to let you know.

16. Contact and complaints

If you have a question or concern about how we handle your information, please contact our Information Officer first so we can try to resolve it at hello@driftestates.co.za.
